We love to share, inspire and connect you to local products and services however we must also ensure you are well versed in our website terms and conditions. Please read these terms and conditions before using the Check In website (Website). By continuing to use the website, you accept these terms and conditions without qualification.

Check In Limited, trading as Check In, is a New Zealand owned and operated business.  All pricing on our website is in New Zealand Dollars (NZD) and all matters are governed by New Zealand law.

General 

Access to and use of the Website is conditional on your acceptance of these terms and conditions. All bookings and booking enquiries are subject to availability and email (or written) confirmation by Check In. 

These terms and conditions apply to all Check In bookings, products and services and are in addition to the terms and conditions of each individual operator and supplier 

Check In reserves the right to change the terms and conditions without prior notice to you.  It is your responsibility to stay up to date with the terms and conditions on the Website.

Check In Limited is a New Zealand registered company and the Terms and Conditions are governed by the laws of New Zealand.  By using the Check In website you agree to governance under the laws of New Zealand and you submit to the jurisdiction of the Courts of New Zealand and/or any relevant tribunals for determining any dispute..


Check In reserves the copyright and all proprietary rights in the website and all content. The material contained within the Website is the property of Check In or its affiliates unless identified as belonging to third parties. The name Check In and any other marks, logos and graphics of Check In displayed on the Website are registered trademarks of Check In Limited. 

Whilst every effort is made to ensure the accuracy of all information and prices displayed on the Website, errors may occur from time to time. In the event that an incorrect price has been offered in error, any booking made based on such incorrect price will not be valid. You will be advised of any such mistake at the earliest opportunity and you will then have the option to pay the correct price or to cancel and receive a full refund of any monies already paid by you.

We may change any aspect of the Website or its content, including the availability of any operators, suppliers, features, information, database or content without prior notice. In additional all images displayed on the Website are included as a guide only. 

The Website is provided on an ‘as is’ and ‘as available’ basis. We do not accept any liability in respect of your ability to access or use the website at any time or for any interruption in that access or use or for any failure to complete any transaction. We do not warrant that the Website is free from computer viruses or other issues that may cause loss or damage.

All timeframes and deadlines prescribed on the Website are in local New Zealand time. 

General Travel Advice 

Check In recommends you purchase comprehensive Travel Insurance and understand all visitor visa requirements.  This is the sole responsibility of you and Check In will not be liable for any loss or costs incurred by you.. 

Travel visas are your responsibility, including those required for any country you are transiting through. Please note that most visitors to New Zealand must have at least 6 months validity on their passport . 

All accommodation properties have strict occupancy limits, at the time of booking you must clearly state the number of adults and children who are to occupy the property, which must not exceed the allowed limit.

Pricing & Online, Telephone, Concierge Bookings 

All prices are in New Zealand Dollars (NZD) and include Goods and Service Tax (GST), currently 15% and subject to change, where applicable. 

Prices on the Website are subject to change without notice. Prices are not guaranteed until paid in full and written confirmation is issued. All prices on the Website are applicable to online bookings only. Prices do not include items of a personal nature (such as telephone calls, alcoholic beverages, gratuities, etc.), unless otherwise stated. 

The applicable inclusions, booking and purchase conditions are those which are accessed from the relevant product and service pages and you agree that you have read these before confirming your booking enquiry, booking or purchase. 

Any special requests submitted through the Website will be passed on to the operator or supplier but cannot be guaranteed. 

Upon receipt by Check In of payment in full for the  booking your booking will be finalised with the operator or supplier . In arranging the booking, we are acting as the agent of the operator or supplier of the relevant product and/or service.

Where you make telephone or concierge bookings, we will draw your attention to the terms and conditions contained on the Website, and by proceeding with your booking you agree to the full terms and conditions of this website including our Privacy Policy as it applies to you.

You must be at least 18 years of age in order to make a booking and you must provide your full name, email address, credit card details and contact telephone number. 

You must ensure that your credit card details and email address are correct and valid at the time of booking. We take no responsibility for any incorrect information submitted. Once your credit card details are processed, your booking details will automatically sent to the operator or supplier and a booking receipt and invoice will be sent to your registered e-mail address. 


Payment 

Full payment is required at the time of booking. 

We accept Visa and MasterCard  – credit card transaction incur a 3% surcharge.  

Cancellation

In any instance where it is necessary for you to cancel your reservation, you must advised Check In directly. Check In will charge a minimum administration fee of 10% of the total value of the cancelled reservation. The remaining refund balance is subject to the operators cancellation policy. In any event where you do not appear for your booked service (no show) 100% cancellation charges apply. 


We reserve the right to offer alternative products or services  of a similar standard if operator or supplier is unable to honour your booking for any reason beyond our control.

Amendments 

Amendments to your booking may attract an administration fee and are subject to availability and pricing variations. Amendments are not guaranteed until confirmed by Check In and are subject to additional costs.

Secure Pay
BookEasy™ Secure Payment Gateway is provided using SecurePay SecureBill Product. SecureBill uses high security levels, which are standard for internet banking and large scale e-commerce sites and involve the use of 128-bit encryption.


You can check the security level of a web page by clicking on your Internet browsers padlock or key icon. Encryption is the standard way of protecting your information as it is transmitted between you and SecurePay. This involves converting the information into an unreadable code using a “key” (and also decoding it using this “key”). The longer the key, the more difficult it is for others to break the encrypted codes.


By using BookEasy™ Secure Payment Gateway you accept all the terms and conditions that apply to the use of its software and the collection by any third party of any personal information in connection with it.


Our Responsibility 

  1. all bookings on the Website are made by you subject to these terms and conditions and also subject to the terms and conditions imposed by operators and suppliers .;
  2. Check In does not guarantee or warrant the standard, class or fitness for purpose of any product or service;
  3. in compiling the Website Check In has used information supplied to it by operators and suppliers of the relevant product or service. Check In has endeavoured to ensure that the information contained on the Website is correct but will not be liable for any loss or damage incurred by you arising out of any inaccuracy.

Your Responsibility 

You agree to be bound by the following obligations, including without limitation:

  1. you accept financial responsibility for all transactions made under your name or account;
  2. you warrant that you are 18 years of age or over and have legal capacity;
  3. you warrant that all information you provide about yourself or anyone else shall be true and accurate;
  4. you shall not use the Website for speculative, false or fraudulent bookings;
  5. the transmission on the Website of threatening, defamatory, pornographic, political, or racist material or any material that is otherwise offensive or unlawful is expressly prohibited; and
  6. the Website and its content may not be modified, copied, transmitted, distributed, sold, displayed, licensed or reproduced in any way by you, except that one copy of the information contained within the Website may be made by you for personal, non-commercial use.

Liability, Indemnity, Force  Majeure 

Check In disclaims and will be exempt from any liability under the law of contract, tort or by virtue of statutory enactment in relation to any:

  1. loss to; 
  2. personal injury, death or illness of;
  3. damage or theft of personal property of any sort of;
  4. expense or inconvenience caused through delay to; 
  5. disappointed expectation of; 
  6. accident befalling,

you and all those booked with you and your invitees, arising out of any negligent act or omission, breach of any duty imposed by statute, breach of any law of the place of destination or on route to or from the destination, tort (whether intentional or unintentional), or breach of a contractual term, whether expressed or implied or breach of duty arising under or imposed by any law on the part of Check In, its servants or agents or  operator of any product or service on the Website.

If Check In is found to be liable its liability will be limited to the value of the booking to Check In (not the value of the booking itself).

Indemnity

You hereby indemnify, defend, and hold Check In harmless from any and all claims which arise out of or are related to, in any manner whatsoever, the business of Check In and its Website as the result of:

(a) any act or omission to act of you and those booked with you, and your agents and invitees, whether based upon breach of contract, negligence, tort, strict liability, or otherwise; or

(b) any breach by you and those booked with you of your warranties or obligations contained in these terms and conditions.

Force Majeure

Check In shall not be liable to you and shall not be deemed to be in default for any failure or delay to observe or perform any of the terms and conditions applicable to it caused or arising out of Force Majeure.

“Force Majeure” means any:

  1. act of God, fire, earthquake, storm or flood;
  2. strike, lockout, work stoppage or other labour hindrance;
  3. explosion, nuclear accident or collision;
  4. sabotage, riot, civil disturbance, insurrection, epidemic, national emergency (whether in fact or law) or act of war (whether declared or not);
  5. requirement or restriction of, or failure to act by, any government, semi-governmental or judicial entity;
  6. unavoidable accident;
  7. loss of supply of essential services including but not limited to electrical power and air conditioning; or
  8. any other cause beyond the reasonable control of Check In.

Privacy 

We respect your privacy and therefore the use of your personal information submitted to us via the Website, over the phone or to our concierge team, will be limited to booking notifications and Check In or partnered offers, information, and activity. As per the Privacy Act, the personal information Check In holds can be viewed, corrected or amended at any time. Check In does not collect personal information when you browse the Website, we do however collect information when you subscribe to our newsletters and updates, enter competitions or register for promotions, take surveys, submit reviews and when making an enquiry or reservation via the Website, by email or phone. 

We are always looking to improve our Website experience and our visitors usage, therefore we will use ‘cookies’ to collect information about your use of the Website – the behaviours we are looking for include, but are not limited to, browsing activity, entry and exit point and specific products or services viewed or booked.  This helps us to develop better visitor experience and to deliver special offers that suit your interests. In addition we may refer to your usage in relation to marketing banners and the like and may disclose this information to third parties, however personal information on individual visitors will not be passed on to a third party. 

Check In Prizes and Competitions (Website, Print & Social Media)

  1. Entry into promotions are open to the following: 
    1. experience based promotion is open to New Zealand residents and visitors to the promotion destination except employees Check In Limited, their advertising and promotional agencies, partnered operators and in all cases their immediate families; Validation is required.
    2. local life based promotions are open to permanent residents of that destination and surrounding areas except employees Check In Limited, their advertising and promotional agencies, partnered operators and in all cases their immediate families. Validation is required. 
  2. All entries must be received within the timeframe specified and Check In will not be held responsible for entries not properly received for any reason, whether or not caused by Check In.
  3. By entering promotions you consent to your content being displayed for public viewing at the discretion of Check In.
  4. Check In’s decisions relating to promotions are final and no correspondence will be entered in to.
  5. Check In reserves the right to terminate or change the promotion or any or all of the prizes at any time without notice.
  6. All entrants must be 18 years or over however if  a promotion is open to all ages the under age entrant must have the consent of a parent(s) or guardian(s).  If an underage contestant wins, they must be accompanied by a parent(s) or guardian(s), and any additional will be at the cost will of the winner.  
  7. For reasons beyond Check In’s control, and where we determine circumstances have corrupted or affect the proper conduct, security, fairness and integrity of the promotion, the promotion may be abandoned or postponed by Check In, and Check In will not accept any responsibility for such an event. 
  8. The winner must assess whether the prize is suitable for them  and in any instance where insurances (travel or similar) are required or recommended to redeem the prize, this will be at the winners discretion and cost. Check In and its associates  will not be liable for any loss or damage suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained, as a result of accepting any prize, except for any liability which cannot be excluded by law.
  9. Social media promotions must be claimed within 30 days, unless otherwise stated. Only one entry per eligible person and by entering the entrant acknowledges that the competition is in no way sponsored, endorsed or administered by, or associated directly with any social media platform (including Facebook, Instagram, Twitter, Snapchat). 
  10. Check In reserves the right to use winners’ names and photos for reasonable publicity associated with the competition.
  11. Entry into promotion is deemed acceptance of these terms and conditions.
